Title: ATTORNEY III

This is a challenging senior level Attorney position involving the interpretation and application of State and federal laws and regulations governing the California air pollution control program. The Attorney III for the California Air Resources Board (ARB) performs the most difficult and complex litigation, negotiation, legislative liaison, hearings, legal research and opinion drafting; renders legal advice and opinions to Board management; responds to difficult legal correspondence; develops strategy and tactics in the most complex disputes or litigation; and coordinates their actions with other ARB attorneys and enforcement staff as needed to maintain consistent enforcement policy and strategy.
Under the supervision of an Assistant Chief Counsel and the general direction of the Chief Counsel, the attorney will focus on California’s regulations related to both mobile sources and climate programs. The attorney will be responsible for providing verbal and written legal advice to ARB's executives, management, and staff on legal issues arising during regulation development, and implementation of California's air quality program. Enforcement activities, coordination with federal and State agencies, interpretation of specific statutory and regulatory provisions, review of legal aspects of staff reports, letters, guidance and other documents, and legal assistance to support Board actions are key functions of this position.
The attorney in this position will also focus on enforcing and defending existing ARB criteria pollutant, toxics and climate regulations and assist ARB staff in the drafting of regulations, regulatory amendments and guidelines throughout the rulemaking process. This position will provide ARB staff and the Chief Counsel with written and verbal advice, draft and review legal correspondence, analyze and recommend potential enforcement actions and perform a variety of related legal tasks.
Work Environment Requirements:Travel between ARB headquarters and other offices (including Southern California) and occasionally out of state travel may be required. Must be available to work overtime as necessary when business needs warrant. The location of this position is in downtown Sacramento.
Candidates should have a desire to advance the underlying objectives of ARB to protect and enhance California's air quality through regulatory approaches, market mechanisms, and other means to reduce harmful air pollution from a wide variety of stationary, vehicular and other mobile sources, and other activities. Candidates should have in depth knowledge of air pollution control, both federal and California laws, experience in dealing with members of the public, technical staff, and other public agencies, be familiar with rulemaking and the functioning of administrative agencies in California, and enforcement of administrative regulations.
