Under general direction of the Tax Counsel III, Supervisor, of the Settlement Section of the Legal Department, the Business Taxes Specialist II (BTS II) performs the following duties with a high degree of independence. The BTS II represents the Settlement Section in independently negotiating settlements of appeals cases involving disputed sales and use tax and special taxes and fees liabilities and complex and sensitive audit issues. The settlements become Board action and a matter of public record. The BTS II independently analyzes cases, evaluates the strengths and weaknesses of the parties’ positions in light of pertinent facts and authorities, evaluates litigation risks and costs, determines reasonable settlement parameters, conducts settlement conferences with taxpayers and feepayers and their representatives, negotiates settlements, writes binding settlement agreements and detailed memoranda that analyze the strengths and weaknesses of the parties’ positions, evaluate litigation risks and costs and explain why the settlement is reasonable and in the State’s best interest. The BTS II may independently represent the Settlement Section in closed session hearings before the five-member Board and provide consultation and assistance to Board Members and their staff, Board management and professional staff, executives and professionals outside the Board and the public. The BTS II may act as trainer of other staff, review decisions and recommendations of other BTS II’s and assist Tax Counsels concerning audit issues; and serve as the Settlement Program’s representative on projects and teams involving other divisions and departments, participate in development of policies and legislation, and prepare or reviews reports and publications.
