CIVIL RIGHTS OPERATIONS – COMPLAINT AND RESPONSE UNIT
STAFF SERVICES MANAGER I (SUPERVISOR)
Under the general direction of the Staff Services Manager II (SSM II), the Staff Services Manager I (SSM I) provides first level supervision to a minimum of three Staff Services Analyst (SSA)/Associate Governmental Program Analysts (AGPA). The incumbent functions as a working level supervisor/subject matter expert and may conduct the most sensitive, complex, internal and external discrimination complaint reviews throughout the CDCR. The Equal Employment Opportunity (EEO)/Sexual Harassment (SH) complaint review conducted by the SSM I may include allegations against high-level administrative staff, multiple respondents and/or multiple allegations, as well as external complaints received from the California Department of Fair Employment and Housing (DFEH) or the U.S. Equal Employment Opportunity Commission (EEOC). These cases often present an increased likelihood of court action, which can result in substantial liability and cost to the Department.
The SSM I oversees the training and performance of the SSA/AGPA’s, and may act as the SSM II in his or her absence. Positions at this level function as supervisory experts.
40% The SSM I supervises the SSA/AGPA’s engaged in the initial review, analysis and completion of all EEO/SH complaints received by CRO statewide. The SSM I provides training and oversight on how to analyze data gathered during an intake, and how to write acceptable analyses and responses to external agencies. All activities are tracked at each phase of the intake process to ensure EEO complaints are completed in a timely manner and all Statute of Limitations for disciplinary actions against CDCR staff are met.
15% The SSM I reviews complex, high profile internal and external complaints to determine if investigation is warranted, applying civil rights laws, rules, regulations and CDCR policies. The SSM I meets with Hiring Authority executives or their managers, conducts reviews with the involved parties, and gathers relevant evidence. The incumbent must be able to communicate effectively with Superintendents, Wardens, Parole Regional Administrators, Chief Executive Officers, and other hiring authorities throughout the complaint process. The SSM I will be called upon to respond to formal discovery requests (interrogatories, subpoenas, position statement requests, and requests to produce) from external agencies that are used by those enforcement agencies to compel a respondent to produce evidence in a formal manner. The incumbent responds orally and in writing to attorneys representing external agencies and charging parties during an investigation, in subsequent court actions, or with settlement discussion. The SSM I independently evaluates complaint information, using the analytical legal framework developed by Department of Fair Employment and Housing (DFEH), Equal Employment Opportunity Commission (EEOC), and the courts.
10% The SSM I ensures that the SSA/AGPA’s organize and prepare the evidence gathered from the complaint, into a complete analysis. The SSM I exercises considerable autonomy and independent judgment analyzing and evaluating evidence obtained during review to ensure that a determination can be made on the merits of the case to be accepted for a complete OIA investigation. The SSM I will review the SSA/AGPA’s response to the external agencies, and provide direction as necessary.
10% The SSM I may participate in the management of the Regional AGPA’s by acting for the Program Manager, recruiting, selecting, and developing staff, including monitoring performance and applying discipline as necessary. The SSM I attends meetings regarding EEO and civil rights issues in the Department.
10% The SSM I assists in conducting EEO/SH complaint training on a statewide basis, in group settings, and one-on-one on the job training for both lower level CRO SSA/AGPA’s, and CDCR EEO Coordinators.
10% The SSM I is directly responsible for recognizing a “probable cause” case in order to move toward settlement and avoid protracted legal proceedings. The SSM I testifies at administrative and civil hearings and depositions, to support the findings of the Department on the most complex and difficult cases. Assists in CRO business planning that includes setting goals and objectives, and developing operation plans as they relate to EEO complaints within the region.
5% The SSM I may perform other duties as required including, but not limited to, assisting in development of policy, procedures, office directives, complete other assignments required to meet CRO operational needs.
ESSENTIAL FUNCTIONS AND SKILLS
Subject Matter Expert knowledge of California Fair Employment and Housing Act, California Family Rights Act, California Ralph Civil Rights Act, U.S. Title VII, U.S. Americans with Disabilities Act, U.S. Family and Medical Leave Act, EEOC guidelines, Department policies and procedures; and rules of evidence; methods of compiling and presenting data. Possess and exercise strong supervisory, analytical, writing and editing skills.
The SSM I will have the ability to conduct complaint reviews in the most sensitive areas throughout the CDCR in a tactful and judicious manner. The SSM I shall demonstrate competence, objectivity, and emotional stability; willingness to work irregular hours, and travel throughout California to CDCR facilities as assigned.
Skills required to perform the essential functions of the position include the ability to communicate effectively both verbally and in writing, read and comprehend written instructions, manuals, and correspondence, and to reason logically while exercising critical analysis skills. The SSM I should have experience equivalent to five years at a journey level civil rights investigator in a state department or at least three years of experience in a state or federal civil rights enforcement agency.
The SSM I receives general supervision from the SSM II and may receive direction from the Chief of CRO.
Adhere to all applicable laws, rules, policies, procedures, and court precedence, including OIA Directives and the DFEH Case Analysis Manual.
The SSM I has contact with Wardens, Superintendents, Regional Parole Administrators, Chief Executive Officers, Executives, managers, supervisors, EEO coordinators, staff, complainants and respondents, witnesses, external enforcement agencies, Departmental attorneys, and private legal representatives.
