Under the general directions of the Assistant Chief Counsel, Appeals Division, and the Tax Counsel III (Supervisor), a Tax Counsel/Tax Counsel III (Specialist) in the Appeals Division conducts conferences throughout the State on complex petitions for redetermination and claims for refund arising from audits under various business tax laws administered by the Board. Evaluates oral and documentary evidence submitted by the parties; researches the law with respect to legal contentions, and prepares written decisions and recommendations. Case assignments include matters involving interpretation of statutes, regulations, or rulings which will have significant economic impact or precedent for future tax administration. Manages case load and meets deadlines. For cases pending before the Board Members: reviews and edits Board hearing summaries; writes, reviews, and edits statements of final action; writes Board hearing summaries and presents appeals to the Board Members at Board hearings; and handles legal issues arising from Board hearings. Advises Board Members, Board staff, Chief Counsel, Assistant Chief Counsel, and Board Proceedings Division on substantive and procedural matters. The Tax Counsel III, Specialist will handle the more complex and difficult case workload.
