POSITION DESCRIPTION
Under the administrative direction of the Director of the Department of Industrial Relations (DIR), the Chief, Claims and Risk Management is responsible to direct the newly established Return to Work Program/Special Earnings Loss Supplement program, and will serve as the first principle policy maker to formulate statewide policies to ensure the Department meets all the constitutional mandates set forth by SB 863; amend existing Workers Compensation Law for improved medical treatment benefits, provide direction for addressing inefficiencies throughout the California Workers' Compensation System, and implement Legislatively recognized "new state" functions relating to the administration of The Workers' Compensation Administration Revolving Fund, and Return to Work Fund.

To ensure proper funds administration, and to centralize existing DIR funding processes, the incumbent will direct a newly established Claims Administration Program, and will oversee the formulation, operation, and program policies of the Workers' Compensation Administration Revolving Fund and the Return to Work (RTW) programs, and will restructure the funds administration of the Uninsured Employers Benefit Trust Fund (UEBTF), and the Subsequent Injuries Benefits Trust Fund (SIBTF). The incumbent will provide guidance, statewide goals and objectives for these programs and consequently measure and verify the effectiveness in order to amend or propose new policies.

The incumbent will ensure a stabilized insurance market by addressing all manners of workforce issues and will implement policies that will have a direct impact on these four funds. The incumbent acts as Risk Manager for the Department including oversight of the Department's workers' compensation program, this includes implementation and oversight of a Threat Assessment and Management Team to establish policies for the Department's comprehensive Work Disability Prevention and Management Program, Education and Outreach programs, and Stay at Work/Return to Work program (SAW/RTW).

The incumbent has delegated authority to develop complex multi-programs, acquire funding, recruit staff, direct and train high level managers, implement and evaluate program services, manage multiple fund budgets and reimbursement funding, provide legislative testimony on program issues, and assess the effectiveness of program services.

ESSENTIAL FUNCTIONS OF THIS POSITION:

Directs all Claims Administration program processes for the Department, including Uninsured Benefit Trust Fund, Subsequent Injuries Trust Fund, Return to Work Fund, Return to work services, and Risk Management, and Education and Outreach functions; oversees implementation of the recent enactment of Senate Bill 863 which mandates a comprehensive reform of California's workers' compensation system and establishes a $120 million per year "Return-to-Work (RTW) Fund and ensures statutory deadlines and regulatory compliance are met by directing a new program in all aspects of policy, planning, evaluation, research, auditing, and day-to-day operations; oversight of the creation of the Return to Work Fund establishing a $120 million per year fund; oversight of the Uninsured Employer's Benefit Trust Fund (pursues recovery of expenditures from the employer, including filing liens against their property and seeking judgments in civil court), and Subsequent Injuries Benefits.

Consults, meets, and collaborates with the Department Director, the Division of Workers' Compensation Division, Workers' Compensation Appeals Board, various legislators and their staff, the Governor's Office, Labor and Workforce Development Agency, and other DIR management to improve the efficiency of the California Workers' Compensation System.

Acts as Risk Manager for the Department including oversight of the Department's workers' compensation program; includes implementation and oversight of a Threat Assessment and Management Team, and providing risk assessment advice where the Director requires operational risks critically assessed. Develops and implements a Work Disability Prevention and Management Program (WDPM) for DIR's workforce. The WDPM will address all safety and health initiatives including the mandated Injury Illness Prevention Program (IIPP), an aggressive Stay at Work/Return to Work Program (SAW/RTW) that significantly reduces the Department's costs for lost time claims, and ensuring the Department's responsibilities are met under State and Federal law for the Interactive Process for Reasonable Accommodation (I-PRA).

Implement the goals of SAW/RTW by providing the opportunity for employees to remain at work while recovering; identifying Modified/Alternative/Transitional work; coordinate with internal program units, medical providers, and interested parties to return the employees to work as soon as medically possible. Provide education and tools that promote and encourage employees to be responsible for a healthy work environment. Develop and promote cost-effective proactive approaches to ergonomic support so that employees receive the advice and help needed to remain healthy at work.

MINIMUM QUALIFICATIONS
Applicants must meet the following minimum qualifications:

Either I
Must be a current State civil service employee with permanent civil service status, as defined in Government Code Section 18546.

Or II
Must be a current or former employee of the Legislature, who resigned or was released from service within the last 12 months, and with two or more consecutive years of service as defined in Government Code Section 18990.

Or III
Must be a current or former nonelected exempt employee of the Executive Branch of government who resigned or was released from service within the last 12 months, and with two or more consecutive years of service (excluding those positions for which the salaries are set by statute) as defined by Government Code Section 18992.

Or IV
Must be a person retired from the United States military, honorably discharged from active military duty with a service-connected disability, or honorably discharged from active duty as defined in Government Code Section 18991.

KNOWLEDGE AND ABILITIES
Applicants must demonstrate the ability to perform high administrative and policy – influencing functions effectively. Such overall ability requires possession of most of the following more specific knowledge and abilities:
(1) Knowledge of the organization and functions of California State Government including the organization and practices of the Legislature and the Executive Branch; principles, practices, and trends of public administration, organization, and management; techniques of organizing and motivating groups; program development and evaluation; methods of administrative problem solving; principles and practices of policy formulation and development; and personnel management techniques; the department’s or agency’s Equal Employment Opportunity Program objectives; and a manager’s role in the Equal Employment Opportunity Program.

(2) Ability to plan, organize, and direct the work of multidisciplinary professional and administrative staff; analyze administrative policies, organization, procedures and practices; integrate the activities of a diverse program to attain common goals; gain the confidence and support of top level administrators and advise them on a wide range of administrative matters; develop cooperative working relationships with representatives of all levels of government, the public, and the Legislature and Executive branches; analyze complex problems and recommend effective courses of action; and prepare and review reports; and effectively contribute to the department’s or agency’s Equal Employment Opportunity objectives.
These knowledge and abilities are expected to be obtained from the following kinds of experience with substantial participation in the formulation, operation and/or evaluation of program policies (experience may have been paid or volunteer; in State service, other government settings, or in a private organization):

CEA Level A Responsible for broad administrative and program activities, including the execution and/or evaluation of program policies.

CEA Level B Responsible for extensive managerial and program administration or broad program manager experience with substantial participation in the formulation, operation, and/or evaluation of program policies.

CEA Level C Responsible for extensive highly professional influence and contributes to program, policy, and the methods to provide professional services needed to set policies, to meet the mission of the State department and often exercising technical and or professional skills that are required at this level.

DESIRABLE QUALIFICATION(S)
Applicants are required to respond to the six "Desirable Qualification" items listed below in this section. These items are designed to identify job achievement in specific areas that demonstrate ability to successfully perform at the Chief, Claims and Risk Management C.E.A. level.

Responses to the Desirable Qualification items will be assessed based on predetermined job-related rating criteria. In appraising the relative qualifications of candidates, consideration will be given to the extent and type of pertinent experience and education over and above that required under the minimum qualifications.

The Statement of Qualifications serves as documentation for each candidate's ability to present information clearly and concisely in writing and should be typed and no more than four pages in length.

DESIRABLE QUALIFICATIONS:

1. Describe your experience overseeing the formulation, operation, and policy implementation of a program in the area of workers' compensation.

2. Demonstrate your knowledge and experience directing a major program's administration of funds. The following details should be included in your response: purpose and policies of the program; independence of action; steps and processes developed to ensure proper funds administration; measurements of success.

3. Describe your knowledge and experience with the Uninsured Benefit Trust Fund, Subsequent Injuries Trust Fund, Return to Work Fund, and Return to Work Services.

4. Describe your experience consulting and collaborating with, including (but not limited to), various DIR Divisions, state agencies, and legislators to address issues of the California Workers' Compensation System.

5. Describe your relevant experience in Risk Management, including (but not limited to), overseeing a Workers' Compensation Program, Work Disability Prevention program, and Stay at Work / Return to Work program.

6. Demonstrate your ability to perform high level administrative and policy influencing functions which include the ability to work under pressure and effectively make high level decisions.

EXAMINATION INFORMATION
A minimum rating of 70% must be attained to obtain list eligibility. Hiring interviews may be conducted with the most qualified candidates. All candidates will receive written notification of their examination results. The result of this examination will be used only to fill the position of Chief, Claims and Risk Management , with the INDUSTRIAL RELATIONS, DEPARTMENT OF. Applications will be retained for twelve months.

The Results of this examination will be used only to fill this position and may be used to fill subsequent vacancies for this position for a period of up to twelve months.

The examination process will consist of an application and resume and Statement of Qualifications evaluation conducted by a screening committee. All interested applicants must file a Standard State application (STD 678), a resume, and a four page Statement of Qualifications.

Applicants are required to respond to the six items in the "Desirable Qualifications" section of this bulletin.

The application and resume must include periods of employment (month/day/year) and civil service classification (not your working title). The Items in the Desirable Qualifications section listed on this bulletin will be used as the standard to screen the applications.

Interviews may be conducted with the most qualified candidates if it is determined necessary, in order to make a selection. Each candidate will be ranked competitively and notified of their examination results.
