POSITION DESCRIPTION
Under the direction and supervision of the Department of Industrial Relations (DIR) Director, the CEA will perform a variety of complex duties involving the Divsion of Occupational Safety and Health's (DOSH) Process Safety Management (PSM) program; leading the implementation of policy decisions on refinery safety and future reform enforcements; coordinating PSM regulations with state, federal and local agencies, and engaging with stakeholders in the health and safety community. The CEA will serve as the liaison for the D1R Director on process safety management and the Interagency Refinery Task Force (IRTF).

Responsibilities include:

Interagency Refinery Task Force: Lead the meetings of the Interagency Refinery Task Force (IRTF), including those of the IRTF's working groups and. subcommittees. Update Task Force members on a regular basis regarding DIR's Process Safety Management (PSM) program. Ensure distribution of relevant data, research and analysis conducted by the PSM program to members of the Task Force. Participate at public meetings and hearings on activities related to the Task Force and process safety, including meetings held by other state regulators, the federal government and private industry.

DOSH / Office of the Director: Oversight of DOSH and Office of the Director's management meetings. Respond to requests and inquiries from the DIR Director and the Labor and Workforce Development Agency (LWDA). Brief the DIR Director on the progress and work products of the Task Force. Prepare proposals and briefings for the DIR Director to share with LWDA officials. Investigate and advise to the D1R Director in the area of long-range planning and Task Force activities. Provide research, technical and management support to the Director of DIR.

Interact with Federal, State, and Local Governments: Coordinate operational and enforcement activities and regulatory priorities with Federal, State and local government officials, including those that are members of the Task Force. Act as a representative of the DIR Director with responsibility for communicating with executive legal officials. Oversee and ensure regulatory revisions and edits to existing process safety and risk management programs. Summarize the existing legal and regulatory framework on process safety management. Ensure policies to improve methods for detecting problems early, such as pipe erosion, by requiring facility-wide hazard reviews.

Engage with Various Stakeholders: interact with public and community stakeholders. Represent the D1R Director before various stakeholder groups on process safety issues. Work with business and industry representatives to ensure they have complete understanding of new enforcement programs. Respond to industry questions on the implementation of new PSM regulations. Explain PSM policy to business and industry officials, as well as employee and employee groups. Assist industry officials in structuring programs that will meet the spirit of the new regulations. Redefine refinery safety culture, by requiring facility-wide safety culture assessments with meaningful worker participation. Ensure the flow of safety and hazardous information from refineries to agencies and to the public.

Oversee the Direction and Management of the PSM Unit: Review activity reports of the PSM program and cases pertaining to DIR and DOSH enforcement activities, and improve overall safety and security by requiring the adoption of inherently safer systems. Strengthen regulatory enforcement capacity to ensure adequate oversight and safer systems. Participate in PSM and Division management meetings and prepare briefing documents for the DIR Director. Ensure PSM District office complies with administrative and DOSH policies and procedures, and that staff members are fully trained in good engineering and best practices that improve incident investigations requiring root cause analyses. Provide the Task Force and its members with information and data gleaned from field inspections. Compile and analyze various types of data generated by DOSH or provided by refinery operators and other agencies.

Research: Analyze research findings regarding the "Recognized and Generally Accepted Good Engineering Practices" (RAGAGEP) in order to ensure California's PSM enforcement is at least consistent with the nationally recognized RAGAGEP. Develop and oversee criteria for enforcement, proficiency, activities and policies of the PSM program. Formulate and recommend changes in policy and implement changes adopted. Account for human factors and organizational changes that can have an impact on safety systems, such as worker training, experience, and fatigue and ensure that forums through the state facilitate communication between agencies and industry, labor and community-based organizations remain effective and strong.

Perform other related duties as assigned.

MINIMUM QUALIFICATIONS
Applicants must meet the following minimum qualifications:

Either I
Must be a current State civil service employee with permanent civil service status, as defined in Government Code Section 18546.

Or II
Must be a current or former employee of the Legislature, who resigned or was released from service within the last 12 months, and with two or more consecutive years of service as defined in Government Code Section 18990.

Or III
Must be a current or former nonelected exempt employee of the Executive Branch of government who resigned or was released from service within the last 12 months, and with two or more consecutive years of service (excluding those positions for which the salaries are set by statute) as defined by Government Code Section 18992.

Or IV
Must be a person retired from the United States military, honorably discharged from active military duty with a service-connected disability, or honorably discharged from active duty as defined in Government Code Section 18991.

KNOWLEDGE AND ABILITIES
Applicants must demonstrate the ability to perform high administrative and policy – influencing functions effectively. Such overall ability requires possession of most of the following more specific knowledge and abilities:
(1) Knowledge of the organization and functions of California State Government including the organization and practices of the Legislature and the Executive Branch; principles, practices, and trends of public administration, organization, and management; techniques of organizing and motivating groups; program development and evaluation; methods of administrative problem solving; principles and practices of policy formulation and development; and personnel management techniques; the department’s or agency’s Equal Employment Opportunity Program objectives; and a manager’s role in the Equal Employment Opportunity Program.

(2) Ability to plan, organize, and direct the work of multidisciplinary professional and administrative staff; analyze administrative policies, organization, procedures and practices; integrate the activities of a diverse program to attain common goals; gain the confidence and support of top level administrators and advise them on a wide range of administrative matters; develop cooperative working relationships with representatives of all levels of government, the public, and the Legislature and Executive branches; analyze complex problems and recommend effective courses of action; and prepare and review reports; and effectively contribute to the department’s or agency’s Equal Employment Opportunity objectives.
These knowledge and abilities are expected to be obtained from the following kinds of experience with substantial participation in the formulation, operation and/or evaluation of program policies (experience may have been paid or volunteer; in State service, other government settings, or in a private organization):

CEA Level A Responsible for broad administrative and program activities, including the execution and/or evaluation of program policies.

CEA Level B Responsible for extensive managerial and program administration or broad program manager experience with substantial participation in the formulation, operation, and/or evaluation of program policies.

CEA Level C Responsible for extensive highly professional influence and contributes to program, policy, and the methods to provide professional services needed to set policies, to meet the mission of the State department and often exercising technical and or professional skills that are required at this level.

DESIRABLE QUALIFICATION(S)
Applicants are required to respond to the six "Desirable Qualification" items listed below in this section. These items are designed to identify job achievement in specific areas that demonstrate ability to successfully perform at the Chief, Process Safety Management C.E.A. level.

Responses to the Desirable Qualification items will be assessed based on predetermined job-related rating criteria. In appraising the relative qualifications of candidates, consideration will be given to the extent and type of pertinent experience and education over and above that required under the minimum qualifications.

The Statement of Qualifications serves as documentation for each candidate's ability to present information clearly and concisely in writing and should be typed and no more than four pages in length.

DESIRABLE QUALIFICATION ITEMS:

1. Describe your professional experience that is relevant to the Chief, Process Safety Management C.E.A. position.

2. Describe your experience collaborating with state, federal, and local agencies to coordinate joint prioritization of operational, enforcement, or regulatory priorities.

3. Demonstrate your ability and experience to act as a primary advisor on policy development, research, implementation, and evaluation of DIR programs.

4. Describe your experience addressing issues and presenting safety information to a variety of audiences in public meetings, public hearings, meetings held by other state regulators, the federal government, private industry, and other stakeholders in the health and safety community.

5. Demonstrate your ability and experience to organize and direct a comprehensive program pertaining to safety management and regulatory enforcement.

6. Demonstrate your experience and ability in evaluating existing safety processes to improve methods for early detection of potential problems.

EXAMINATION INFORMATION
A minimum rating of 70% must be attained to obtain list eligibility. Hiring interviews may be conducted with the most qualified candidates. All candidates will receive written notification of their examination results. The result of this examination will be used only to fill the position of Chief, Process Safety Management, with the INDUSTRIAL RELATIONS, DEPARTMENT OF. Applications will be retained for twelve months.

The Results of this examination will be used only to fill this position and may be used to fill subsequent vacancies for this position for a period of up to twelve months.

The examination process will consist of an application and resume and Statement of Qualifications evaluation conducted by a screening committee. All interested applicants must file a Standard State application (STD 678), a resume, and a four page Statement of Qualifications.

Applicants are required to respond to the six items in the "Desirable Qualifications" section of this bulletin.

The application and resume must include periods of employment (month/day/year) and civil service classification (not your working title). The Items in the Desirable Qualifications section listed on this bulletin will be used as the standard to screen the applications.

Interviews may be conducted with the most qualified candidates if it is determined necessary, in order to make a selection. Each candidate will be ranked competitively and notified of their examination results.
