POSITION DESCRIPTION
Under the general direction of the Chief Deputy, General Counsel Operations, Office of Legal Affairs (OLA), the Chief Counsel I, C.E.A. is responsible for managing the Employment Advocacy and Prosecution Team (EAPT) for the California Department of Corrections and Rehabilitation (CDCR), which is the team responsible for operation of the Vertical Advocacy Model associated with employee disciplinary matters and matters relating to the Department's internal affairs investigations.

Duties include but are not limited to:

Provides legal advice to the Secretary, the General Counsel, and the Chief Deputy General Counsels on issues relating to employee discipline matters. Formulates legal strategies, policies, and recommendations for management action. Interacts with program and legal management of CDCR and other departments, the Office of the Inspector General, and other public and private entities.

Responsible for the overall management and supervision in planning, organizing, coordinating, reviewing, and directing the work of the EAPT legal staff. Evaluates performance of supervisory staff and actively participates in the selection process of staff. Provides direction to staff for policy implementation and compliance with CDCR policies and procedures. Provides information and projections of legal expenditures in support of the budgetary process. Responsible for the most complex administrative problems.

Provides direction to the EAPT Assistant Chief Counsels and other professional staff for particular cases of a complex nature.

Supervises the EAPT Equal Employment Opportunity (EEO) lawyer(s), including participating in mediations at the California Department of Fair Employment and Housing or the Federal EEO Commission.

MINIMUM QUALIFICATIONS
Applicants must meet the following minimum qualifications.

Membership in The State Bar of California. (Applicants must have active membership in The State Bar before they will be eligible for appointment.) and

Either I
Two years of experience in the California state service performing legal duties* at a level of responsibility equivalent to Staff Counsel, Range D. (Applicants who have completed 18 months of the required experience will be admitted to the examination, but must complete two years of such experience before they will be eligible for appointment.)

Or II
Broad and extensive experience (more than five years) in the practice of law*. Experience in California state service applied toward this requirement must include the same number of years of qualifying experience as required in Pattern I above performing the duties of a class at a level of responsibility equivalent to that described in Pattern I.)

*Experience in the "practice of law" or "performing legal duties" is defined as only that legal experience acquired after admission to The Bar.

KNOWLEDGE AND ABILITIES
Knowledge of: Legal principles and their applications; legal research methods, court procedures, rules of evidence and procedure; administrative law and the conduct of proceedings before administrative bodies; provisions of laws and Government Code sections administered or enforced; principles of public administration, personnel management and supervision; the department's equal employment opportunity objectives; a manager's role n the affirmative action program and the processes available to meet equal employment opportunity objectives.

Ability to: Analyze legal principles and precedents and apply them to complex legal and administrative problems; present statements of fact, law and argument clearly and logically in written and oral form; draft opinions, pleadings, rulings, regulations and legislation; hold hearings and independently present difficult and complex cases in court; plan, organize and direct the work of a staff of attorneys; effectively contribute to the department's equal employment opportunity objectives.

DESIRABLE QUALIFICATION(S)
1. Experience in the management of a legal program in a large agency dealing with department disciplinary processes; and knowledge of those specific legal principles and their applications; legal research methods, court procedures, rules of evidence and procedures; administrative law and the conduct of proceedings before administrative bodies related to disciplinary actions and processes.

2. Experience in the formulation and implementation of legal strategies and policies for a large, complex legal program.

3. Experience in public administration, personnel management, leadership, and supervision which demonstrates the ability to motivate staff and manage large groups; and knowledge of the manager's role in providing equal employment opportunity in the work place.

4. Demonstrated abilities in presenting statements of fact, law, and argument clearly and logically both orally and in writing; and developing cooperative working relationships with the federally appointed Special Master, peer managers, private counsel, Legislative and Executive Branch members, state and federal agencies.

5. Ability to analyze legal principles and precedents and apply them to complex legal and administrative problems and recommend and/or implement an effective course of action not only in general legal proceedings but also as they relate to the area of disciplinary action and proceedings.

EXAMINATION INFORMATION
A minimum rating of 70% must be attained to obtain list eligibility. Hiring interviews may be conducted with the most qualified candidates. All candidates will receive written notification of their examination results. The result of this examination will be used only to fill the position of Chief Counsel I, C.E.A., with the CORRECTIONS AND REHABILITATION, DEPARTMENT OF . Applications will be retained for twelve months.

The Results of this examination will be used only to fill this position.

This examination will consist of a review by an executive screening committee of the candidates’ Statement of Qualifications that describes their experience, knowledge, and abilities as they relate to the desirable qualifications identified in the bulletin, using predetermined evaluation criteria.
