POSITION DESCRIPTION
Under the general direction of Commissioner of Business Oversight, the Deputy Commissioner plans, organizes, directs and reviews the work of the staff of examiners and other professionals engaged in the administration of the California Finance Lenders Law, California Deferred Deposit Transaction Law, Escrow Law, Check Seller, Bill Payer and Prorater Law; participates in the overall policy development and management direction of the Department of Business Oversight.

Recommends policies and procedures and directs their implementation in the Division of Financial Services of the Department of Business Oversight. Plans, organizes, directs and reviews the work of staff engaged in administering the California Finance Lenders Law, California Deferred Deposit Transaction Law, and the Check Seller, Bill Payer and Prorater Law under the jurisdiction of the Commissioner of Business Oversight. Participates in the overall policy development and management direction of the Department of Business Oversight. Directs the review of applications for issuance and denials of licenses; directs the examinations of licensees making a determination regarding the suspension and revocation of licenses and determine enforcement action against a license; provides assistance to the Commissioner in establishing policy through study and analysis of legal, economic and industrial developments affecting the financial service laws administered by the Department.

Plans, organizes and directs the statewide examination program of the Division of Financial Services; reviews methods and procedures for examination of accounts and records of FSD licensees, such as, escrow agents, finance lenders, and pay day lenders. Makes determinations on difficult and unusual technical questions; participates in conferences with regulators from other States, business leaders, attorneys, independent accountants and other stakeholders to discuss examination findings; studying and making recommendations concerning applicants and licensees.

Makes recommendations to the Commissioner in matters affecting the operations of the Division; upon request by the Commissioner or Senior Deputy Commissioner, represents the Division at various gatherings, conferences and hearings; preparing periodical reports to the Commissioner relative to the activities of the Financial Services Office.

Serves as a member of the Commissioner's Executive Staff, and participates in making decisions that affect major departmental policies. Other duties as required.

The position will be filled in a DBO Statewide Office (Locations include Los Angeles, Sacramento, San Diego, or San Francisco.).

Note: Eligibility to take a CEA examination does not require current permanent status in the civil service.

KNOWLEDGE AND ABILITIES
Applicants must demonstrate the ability to perform high administrative and policy – influencing functions effectively. Such overall ability requires possession of most of the following more specific knowledge and abilities:
(1) Knowledge of the organization and functions of California State Government including the organization and practices of the Legislature and the Executive Branch; principles, practices, and trends of public administration, organization, and management; techniques of organizing and motivating groups; program development and evaluation; methods of administrative problem solving; principles and practices of policy formulation and development; and personnel management techniques; the department’s or agency’s Equal Employment Opportunity Program objectives; and a manager’s role in the Equal Employment Opportunity Program.

(2) Ability to plan, organize, and direct the work of multidisciplinary professional and administrative staff; analyze administrative policies, organization, procedures and practices; integrate the activities of a diverse program to attain common goals; gain the confidence and support of top level administrators and advise them on a wide range of administrative matters; develop cooperative working relationships with representatives of all levels of government, the public, and the Legislature and Executive branches; analyze complex problems and recommend effective courses of action; and prepare and review reports; and effectively contribute to the department’s or agency’s Equal Employment Opportunity objectives.
These knowledge and abilities are expected to be obtained from the following kinds of experience with substantial participation in the formulation, operation and/or evaluation of program policies (experience may have been paid or volunteer; in State service, other government settings, or in a private organization):

CEA Level A Responsible for broad administrative and program activities, including the execution and/or evaluation of program policies.

CEA Level B Responsible for extensive managerial and program administration or broad program manager experience with substantial participation in the formulation, operation, and/or evaluation of program policies.

CEA Level C Responsible for extensive highly professional influence and contributes to program, policy, and the methods to provide professional services needed to set policies, to meet the mission of the State department and often exercising technical and or professional skills that are required at this level.

DESIRABLE QUALIFICATION(S)
1. Demonstrated knowledge and understanding of California and federal law, regulations, policies and programs including the Government Code, Financial Code and sections pertaining to the California Finance Lender Law, California Deferred Deposit Transaction Law, California Residential Mortgage Lending Act, Escrow Law, Pay Day Lender Law, Mortgage Loan Originator, and the Check Seller, Bill Payer and Prorater's Law.

2. Demonstrated knowledge of risk identification and mitigation for financial services providers and experience in examining and seeking enforcement action against financial services providers.

3. Ability to facilitate continuous improvement through sophisticated performance metrics and project management techniques, and supporting the creation and enhancement of department policies.

4. Demonstrated ability to communicate effectively orally to individuals and groups, including the presentation of findings to licensees, stakeholders, department executives, other governmental agencies, and industry trade associations.

5. Exceptional written communication skills, able to write and edit clearly and present Department positions in a manner easily understood by the department, general public, and licensees alike.

6. Demonstrated ability to work collaboratively with the public, licensee, and within State and Federal legislative and executive branches.

7. Strong leadership skills and experience in change management, policy development and program administration.

EXAMINATION INFORMATION
A minimum rating of 70% must be attained to obtain list eligibility. Hiring interviews may be conducted with the most qualified candidates. All candidates will receive written notification of their examination results. The result of this examination will be used only to fill the position of Deputy Commissioner, Financial Services, with the BUSINESS OVERSIGHT, DEPARTMENT OF. Applications will be retained for twelve months.

The Results of this examination will be used only to fill this position and may be used to fill subsequent vacancies for this position for a period of up to twelve months.

The Statement of Qualifications will be used to evaluate your education and experience as it relates to the "Desirable Qualifications" listed above, and may also serve as documentation of each candidate's ability to present information clearly and concisely in writing since this is a critical factor to successful job performance.
