POSITION DESCRIPTION
Under the general direction of the Commissioner of Business Oversight, the Deputy Commissioner plans, organizes, directs, and reviews the work of staff examiners and other professionals engaged in the administration of the California Residential Mortgage Lending Act (CRMLA) and Mortgage Loan Originator (MLO)statutes and through a subordinate manager oversees the Consumer Complaint and support staff units within the Mortgage Lending Office.

Recommends policies and procedures and the direction of their implementation in the Mortgage Lending Office of the Department of Business Oversight. Plans, organizes, directs, and reviews the work of staff engaged in administering the CRMLA and MLO statutes under the jurisdiction of the Commissioner of Business Oversight. Directs the review of applications for issuance and denials of licenses, suspension and revocations of licenses, and determines enforcement action referrals against a license. Provides recommendations to the Commissioner in establishing policy through study and analysis of legal, economic, and industrial developments affecting the mortgage lending laws administered by the Department.

Plans, organizes and directs the state-wide examination program of the mortgage lenders, mortgage servicers, and mortgage originators. Passes on the methods and procedures for examination of accounts and records of such business organizations in the business of mortgage lending and servicing. Participates in conferences with regulators from other States, business leaders, attorneys, independent accountants, and others to discuss examination findings.

Plans, organizes and directs the processing, investigation, and management of consumer complaints related to mortgage lending and financial transactions. Determines educational needs of staff to ensure they are kept abreast of changes to the laws. Reviews the analysis of complaints and makes final recommendation on enforcement action referrals to be taken against a license. Oversees the support staff assigned to assist with the clerical functions related to the Mortgage Lending Office activities.

Advises the Commissioner in matters affecting the operations of the Mortgage Lending Office. Represents the Commissioner at various gatherings, conferences, and hearings. Prepares periodical reports to the Commissioner relative to the activities of the Mortgage Lending Office.

Serves as a member of the Commissioner's Executive Staff, and participates in the overall policy development and management direction of the Department of Business Oversight. Other duties as required.

This position exists in Los Angeles.

MINIMUM QUALIFICATIONS
Applicants must meet the following minimum qualifications:

Either I
Must be a current State civil service employee with permanent civil service status, as defined in Government Code Section 18546.

Or II
Must be a current or former employee of the Legislature, who resigned or was released from service within the last 12 months, and with two or more consecutive years of service as defined in Government Code Section 18990.

Or III
Must be a current or former nonelected exempt employee of the Executive Branch of government who resigned or was released from service within the last 12 months, and with two or more consecutive years of service (excluding those positions for which the salaries are set by statute) as defined by Government Code Section 18992.

Or IV
Must be a person retired from the United States military, honorably discharged from active military duty with a service-connected disability, or honorably discharged from active duty as defined in Government Code Section 18991.

KNOWLEDGE AND ABILITIES
Applicants must demonstrate the ability to perform high administrative and policy – influencing functions effectively. Such overall ability requires possession of most of the following more specific knowledge and abilities:
(1) Knowledge of the organization and functions of California State Government including the organization and practices of the Legislature and the Executive Branch; principles, practices, and trends of public administration, organization, and management; techniques of organizing and motivating groups; program development and evaluation; methods of administrative problem solving; principles and practices of policy formulation and development; and personnel management techniques; the department’s or agency’s Equal Employment Opportunity Program objectives; and a manager’s role in the Equal Employment Opportunity Program.

(2) Ability to plan, organize, and direct the work of multidisciplinary professional and administrative staff; analyze administrative policies, organization, procedures and practices; integrate the activities of a diverse program to attain common goals; gain the confidence and support of top level administrators and advise them on a wide range of administrative matters; develop cooperative working relationships with representatives of all levels of government, the public, and the Legislature and Executive branches; analyze complex problems and recommend effective courses of action; and prepare and review reports; and effectively contribute to the department’s or agency’s Equal Employment Opportunity objectives.
These knowledge and abilities are expected to be obtained from the following kinds of experience with substantial participation in the formulation, operation and/or evaluation of program policies (experience may have been paid or volunteer; in State service, other government settings, or in a private organization):

CEA Level A Responsible for broad administrative and program activities, including the execution and/or evaluation of program policies.

CEA Level B Responsible for extensive managerial and program administration or broad program manager experience with substantial participation in the formulation, operation, and/or evaluation of program policies.

CEA Level C Responsible for extensive highly professional influence and contributes to program, policy, and the methods to provide professional services needed to set policies, to meet the mission of the State department and often exercising technical and or professional skills that are required at this level.

DESIRABLE QUALIFICATION(S)
1. Demonstrated knowledge and understanding of California and federal law, regulations, policies and programs including the Government Code, Financial Code and sections pertaining to the California Residential Mortgage Lending Act and Mortgage Loan Originator laws.

2. Demonstrated knowledge of risk identification and mitigation for mortgage lending and servicing providers and experience in examining and seeking enforcement action against mortgage lending and servicing providers.

3. Demonstrated knowledge and experience in processing, investigating, and managing consumer complaints related to mortgage lending and financial transactions.

4. Ability to facilitate continuous improvement through sophisticated performance metrics and project management techniques, and supporting the creation and enhancement of department policies.

5. Demonstrated ability to communicate effectively orally to individuals and groups, including the presentation of findings to licensees, stakeholders, department executives, other governmental agencies, and industry trade associations.

6. Exceptional written communication skills, able to write and edit clearly and present Department positions in a manner easily understood by the department, general public, and licensees alike.

7. Demonstrated ability to work collaboratively with the public, licensee, and within State and Federal legislative and executive branches.

8. Strong leadership skills and experience in change management, policy development, and program administration.

EXAMINATION INFORMATION
A minimum rating of 70% must be attained to obtain list eligibility. Hiring interviews may be conducted with the most qualified candidates. All candidates will receive written notification of their examination results. The result of this examination will be used only to fill the position of Deputy Commissioner, Mortgage Lending Office, with the BUSINESS OVERSIGHT, DEPARTMENT OF. Applications will be retained for twelve months.

The Results of this examination will be used only to fill this position and may be used to fill subsequent vacancies for this position for a period of up to twelve months.
