POSITION DESCRIPTION
This position may be located in any statewide office of the Division of Workers' Compensation.

Under the general direction and supervision of the Administrative Director of the Division of Workers’ Compensation (A.D.), the Chief Judge is responsible for the day-to-day management, including planning, organizing and directing, of the judicial work of over 700 fulltime employees of the Division of Workers’ Compensation (DWC).

Through subordinate staff, plans, organizes and directs the work of the judicial staff; establishes and monitors procedures for effective maintenance of case calendars; participates in the planning and direction of management programs in the areas of policy formulation and implementation, budget recommendations, and legislation; and, assists in the coordination of the judicial, legal, medical and related operational activities of the Division.

Ensures appropriate staffing of the Division’s 24 district offices so that statutory and internal time deadlines for adjudication of workers’ compensation disputes can be met. Oversees and coordinates with the Department’s Personnel Office on the Civil Service selection process, including recruitment and the scheduling of exams. Coordinates the planning and implementation of training and continuing education for judges as well as support staff. Reviews and evaluates the performance of assigned staff. Coordinates with the Personnel Office and the Director’s legal staff in investigating allegations of misconduct and makes recommendations to the A.D. concerning discipline of the judicial staff.

Coordinates with senior members of the judicial staff and Deputy Commissioners of the Workers’ Compensation Appeals Board (WCAB) on development and planning of rules, regulations, policies and procedures necessary to implement legislation or otherwise make the adjudication process more productive and efficient. Coordinates with the WCAB in areas of mutual concern including venue, consolidation of cases and assignment of cases, and sanction and contempt procedures.

Acts as A.D. in the absence of the A.D. upon designation by the A.D. Speaks publicly on behalf of the A.D. and attends conferences or meetings of employers, the insurance industry, labor organizations, and State and Federal agencies at the request of the A.D. Makes certain that questions from the public, legislators, injured works, and other aggrieved parties concerning the judicial staff are responded to promptly.

Note: Eligibility to take a CEA examination does not require current permanent status in the civil service.

KNOWLEDGE AND ABILITIES
Applicants must demonstrate the ability to perform high administrative and policy – influencing functions effectively. Such overall ability requires possession of most of the following more specific knowledge and abilities:
(1) Knowledge of the organization and functions of California State Government including the organization and practices of the Legislature and the Executive Branch; principles, practices, and trends of public administration, organization, and management; techniques of organizing and motivating groups; program development and evaluation; methods of administrative problem solving; principles and practices of policy formulation and development; and personnel management techniques; the department’s or agency’s Equal Employment Opportunity Program objectives; and a manager’s role in the Equal Employment Opportunity Program.

(2) Ability to plan, organize, and direct the work of multidisciplinary professional and administrative staff; analyze administrative policies, organization, procedures and practices; integrate the activities of a diverse program to attain common goals; gain the confidence and support of top level administrators and advise them on a wide range of administrative matters; develop cooperative working relationships with representatives of all levels of government, the public, and the Legislature and Executive branches; analyze complex problems and recommend effective courses of action; and prepare and review reports; and effectively contribute to the department’s or agency’s Equal Employment Opportunity objectives.
These knowledge and abilities are expected to be obtained from the following kinds of experience with substantial participation in the formulation, operation and/or evaluation of program policies (experience may have been paid or volunteer; in State service, other government settings, or in a private organization):

CEA Level A Responsible for broad administrative and program activities, including the execution and/or evaluation of program policies.

CEA Level B Responsible for extensive managerial and program administration or broad program manager experience with substantial participation in the formulation, operation, and/or evaluation of program policies.

CEA Level C Responsible for extensive highly professional influence and contributes to program, policy, and the methods to provide professional services needed to set policies, to meet the mission of the State department and often exercising technical and or professional skills that are required at this level.

DESIRABLE QUALIFICATION(S)
Applicants are required to respond to the eight "Desirable Qualification" items listed below in this section. These items are designed to identify job achievement in specific areas that demonstrate ability to successfully perform at the Chief Judge, Division of Workers' Compensation C.E.A. level. Responses to the Desirable Qualification items will be assessed based on predetermined job-related rating criteria. In appraising the relative qualifications of candidates, consideration will be given to the extent and type of pertinent experience and education over and above that required under the minimum qualifications.

The Statement of Qualifications serves as documentation for each candidate's ability to present information clearly and concisely in writing and should be typed and no more than six pages in length.

DESIRABLE QUALIFICATIONS:

1. Describe your management and administrative leadership experience overseeing judicial work, including the ability to facilitate the establishment of priorities, provide direction, identify training needs to provide training opportunities, and build an effective judicial staff.

2. Describe the depth and breadth of your experience practicing workers’ compensation law, including any experience conducting judicial proceedings, and issuing rulings.

3. Demonstrate your knowledge and understanding of the critical issues confronting California’s Workers’ Compensation system, and the effect of recent legislative changes.

4. Demonstrate your knowledge and understanding of the purpose and role of the Workers' Compensation Appeals Board (WCAB), including the Appellate process, the types of Decisions the WCAB issues, and how you envision the interaction between the WCAB and the Division of Worker’s Compensation.

5. Demonstrate your in-depth knowledge of the Code of Judicial Ethics, the Chief Judge’s role to ensure the Code is upheld by all judicial staff, and the purpose and role of the Workers' Compensation Ethics Advisory Committee.

6. Demonstrate your experience and ability to address complex, difficult, and sensitive personnel issues through various personnel policies, including and up to, progressive discipline.

7. Demonstrate your experience and ability communicating effectively in oral and written form, including but not limited to, public speaking, advising and interacting with executive level management, addressing public inquiries, and issuing written memos on relevant information impacting staff.

8. Describe efforts you would undertake to ensure that judges properly follow the statutes, regulations, and precedential case decisions so as to be in compliance with the judges’ duty under the code of judicial ethics to respect and comply with the law.

EXAMINATION INFORMATION
A minimum rating of 70% must be attained to obtain list eligibility. Hiring interviews may be conducted with the most qualified candidates. All candidates will receive written notification of their examination results. The result of this examination will be used only to fill the position of Chief Judge, Division of Workers' Compensation , with the INDUSTRIAL RELATIONS, DEPARTMENT OF. Applications will be retained for twelve months.

The Results of this examination will be used only to fill this position and may be used to fill subsequent vacancies for this position for a period of up to twelve months.

The examination process will consist of an application, resume and Statement of Qualifications evaluation conducted by a screening committee. All interested applicants must file a Standard State application (STD 678), a resume, and a Statement of Qualifications (not to exceed six pages).

The Items in the Desirable Qualifications section listed on this bulletin will be used as the standard to screen the applications.
