POSITION DESCRIPTION
Manages all functions of the Appellate Unit so that timely and appropriate responses are prepared and filed in appellate litigation and that proper pleadings are filed in state and federal courts to protect the Appeals Board's jurisdiction, to enforce its rules and procedures, and to answer lawsuits or complaints; communicates with commissioners on pending cases and preparation and processing of decisions and pleadings in accordance with instruction of commissioners.

Acts as liaison between reviewing courts and the Appeals Board in all appellate activity; initiates correspondence with the courts to alleviate burdensome and costly procedures; responds to inquiries from the court relating to Board procedures and questions of law; apprises Board of significant state and federal statutory and decisional law changes in the area of workers' compensation law. Confers with the Chair and Secretary of Appeals Board on legal and administrative matters relating to management of assigned unit as well as overall Board policy and management.

Prepares written appellate briefs and participates in oral argument in Courts of Appeal and Supreme Court and occasionally appears in other courts; prepares en banc and significant panel decisions; reviews cases for legal correctness after the panel of commissioners on a case has recommended denying reconsideration by incorporation of the workers' compensation judge's report; serves as expert resource on workers' compensation law providing advice and assistance to commissioners in resolving issues before them.

Pursuant to assignment by the Chair, participates as Appeals Board member in the reconsideration process. Performs Secretary's duties in Secretary's absence, conducts hearings for Appeals Board, resolves conflicts between presiding workers' compensation judges of different offices regarding assignment of a case, venue, or priority of hearing pursuant to WCAB Rule 10346; has overall responsibility for library and ordering of legal books and reports; responds to inquiries from local Board offices on procedural and other matters; assigns hearings on workers' compensation claims of Division of Workers' Compensation employees pursuant to WCAB Rule 10409.

MINIMUM QUALIFICATIONS
Applicants must meet the following minimum qualifications:

Either I
Must be a current State civil service employee with permanent civil service status, as defined in Government Code Section 18546.

Or II
Must be a current or former employee of the Legislature, who resigned or was released from service within the last 12 months, and with two or more consecutive years of service as defined in Government Code Section 18990.

Or III
Must be a current or former nonelected exempt employee of the Executive Branch of government who resigned or was released from service within the last 12 months, and with two or more consecutive years of service (excluding those positions for which the salaries are set by statute) as defined by Government Code Section 18992.

Or IV
Must be a person retired from the United States military, honorably discharged from active military duty with a service-connected disability, or honorably discharged from active duty as defined in Government Code Section 18991.

SPECIAL REQUIREMENTS
Membership in The State Bar of California (Applicants must have active membership in the The State Bar before they will be eligbile for appointment).

KNOWLEDGE AND ABILITIES
Applicants must demonstrate the ability to perform high administrative and policy – influencing functions effectively. Such overall ability requires possession of most of the following more specific knowledge and abilities:
(1) Knowledge of the organization and functions of California State Government including the organization and practices of the Legislature and the Executive Branch; principles, practices, and trends of public administration, organization, and management; techniques of organizing and motivating groups; program development and evaluation; methods of administrative problem solving; principles and practices of policy formulation and development; and personnel management techniques; the department’s or agency’s Equal Employment Opportunity Program objectives; and a manager’s role in the Equal Employment Opportunity Program.

(2) Ability to plan, organize, and direct the work of multidisciplinary professional and administrative staff; analyze administrative policies, organization, procedures and practices; integrate the activities of a diverse program to attain common goals; gain the confidence and support of top level administrators and advise them on a wide range of administrative matters; develop cooperative working relationships with representatives of all levels of government, the public, and the Legislature and Executive branches; analyze complex problems and recommend effective courses of action; and prepare and review reports; and effectively contribute to the department’s or agency’s Equal Employment Opportunity objectives.
These knowledge and abilities are expected to be obtained from the following kinds of experience with substantial participation in the formulation, operation and/or evaluation of program policies (experience may have been paid or volunteer; in State service, other government settings, or in a private organization):

CEA Level A Responsible for broad administrative and program activities, including the execution and/or evaluation of program policies.

CEA Level B Responsible for extensive managerial and program administration or broad program manager experience with substantial participation in the formulation, operation, and/or evaluation of program policies.

CEA Level C Responsible for extensive highly professional influence and contributes to program, policy, and the methods to provide professional services needed to set policies, to meet the mission of the State department and often exercising technical and or professional skills that are required at this level.

DESIRABLE QUALIFICATION(S)
Applicants are required to respond to the five "Desirable Qualification" items listed below in this section. These items are designed to identify job achievement in specific areas that demonstrate ability to successfully perform at the Deputy Commissioner, Workers' Compensation Appeals Board C.E.A. level.

Responses to the Desirable Qualfication items will be assessed based on predetermined job-related rating criteria. In appraising the relative qualifications of candidates, consideration will be given to the extent and type of pertinent experience and education over and above that required under the minimum qualifications.

The Statement of Qualifications serves as documentation for each candidate's ability to present information clearly and concisely in writing and should be typed and no more than three pages in length.

INSTRUCTIONS: When responding to the Desirable Qualification items below, please follow these guidelines:

Responses must be typewritten or generated by word processing on 8 1/2" X 11" paper. Identify each page with your full name. Responses must be limited to one page per item. (Should not exceed a TOTAL of three pages in length).

Answer each numbered item separately indicating the corresponding item number for each response. You may include multiple responses on a single page.

Make sure your responses are complete, specific, clear, and concise.

Include place of employment, pertinent dates, duties performed, etc., when responding to items. In the event that one particular job contained responsibilities applicable to several items, separate the different functions of the job in order to respond to all items completely.

DESIRABLE QUALIFICATION ITEMS:

1. Describe your experience performing legal research, analyzing and appraising of legal problems, and legal writing.

2. Demonstrate your knowledge and understanding of the critical issues confronting the Workers’ Compensation Appeals Board.

3. Describe your appellate experience and understanding of state and federal appellate procedures.

4. Demonstrate your ability to prepare statements of fact, laws and arguments clearly and logically in written or oral form.

5. Describe your experience as a supervisor and/or mentor of attorneys.

EXAMINATION INFORMATION
A minimum rating of 70% must be attained to obtain list eligibility. Hiring interviews may be conducted with the most qualified candidates. All candidates will receive written notification of their examination results. Applications will be retained for twelve months.

The Results of this examination may be used to make additional appointments to CEA positions that are substantially the same and used to fill subsequent vacancies for these position(s) for a period of up to twelve months. The additional position title(s) are listed below:

The examination process will consist of an application and resume and Statement of Qualifications evaluation conducted by a screening committee. All interested applicants must file a Standard State application (STD 678), a resume, and a three-page Statement of Qualifications.

Applicants are required to respond to the five items in the "Desirable Qualifications" section of this bulletin.

The application and resume must include periods of employment (month/day/year) and civil service classification (not your working title). The Items in the Desirable Qualifications section listed on this bulletin will be used as the standard to screen the applications.

Interviews may be conducted with the most qualified candidates if it is determined necessary, in order to make a selection. Each candidate will be ranked competitively and notified of their examination results.

Applicants who fail to submit all required documents listed above by the final file date will be eliminated from the examination.

On the Statement of Qualifications, you must list each Desirable Qualification Item and describe your experience, knowledge, and abilities as they relate to the item.

The Statement of Qualifications should not exceed three pages in length with a font no smaller than 10 point.

If you meet the requirements stated in this bulletin, you may take this examination, which is competitive. Possession of the entrance requirements does not assure a place on the eligible list. Your performance in the examination described on this bulletin will be compared with the performance of others who take this test, and all candidates who pass will be ranked according to their scores.
