POSITION DESCRIPTION
Under the general direction of the Chief Counsel of the Department, the Assistant Chief Counsel (ACC) is the second highest -level attorney position in the Department, and frequently reports directly to the Director. The ACC serves as a member of the Director's executive management team, providing counsel and policy advice to the executive management team on a broad range of legal and non-legal issues facing the Department. With the Chief Counsel, the ACC plans, directs, coordinates, and reviews the attorney and investigator work in the regional offices of the Office of the Director, Legal Unit (ODL). The ACC directs work in multiple substantive areas of labor and employment law, including: defense of employee claims of civil service, discrimination, and pay violations; public works coverage determinations; and apprenticeship standards. The incumbent in this class is an expert attorney who has demonstrated the capacity for independence and responsibility, performing some of the most difficult legal work in the Department, much of which has policy and significant fiscal implications. Incumbent receives minimal direction on policy and resource allocation from the Chief Counsel. Finally, in the absence of the Chief Counsel, the ACC acts in the capacity of Chief Counsel.

Plans, directs, coordinates, and reviews the work of the Industrial Relations Counsels and Special Investigators in the regional office, and on statewide basis in substantive areas.

Develops policy pertaining to public works coverage; reviews coverage determinations for policy considerations and advises the Director on which determinations to make precedential; proposes policy on the promulgation of regulations and legislation, and Civil Rights matters involving discrimination, labor, and employment.

Litigates the most difficult and sensitive issues in both state and federal court and before state and federal agencies.

Proposes and reviews pending legislation to implement policy initiatives. Drafts and supervises the drafting of legislation and legislative analyses, negotiates with parties interested in legislation; interfaces with Agency and Governor's Office regarding policy initiatives and pending legislation, and attends and testifies at legislative committee meetings; proposes, reviews and oversees the drafting of administrative rules and participates in the public rule making process.

Meets with Agency staff, the regulated public, and others to discuss current policy issues of importance and resolution of those issues; responds to inquiries from the Legislature, the Governor's office, and members of the public; represents the Director at conferences, seminars and other forums dealing with the Department's mission.

Develops policy pertaining to Apprenticeship standards: Proposes policy on approval or non approval of apprenticeship programs; coordination with the U.S. Department of Labor; regulatory and statutory amendments to the law.

MINIMUM QUALIFICATIONS
Applicants must meet the following minimum qualifications:

Either I
Must be a current State civil service employee with permanent civil service status, as defined in Government Code Section 18546.

Or II
Must be a current or former employee of the Legislature, who resigned or was released from service within the last 12 months, and with two or more consecutive years of service as defined in Government Code Section 18990.

Or III
Must be a current or former nonelected exempt employee of the Executive Branch of government who resigned or was released from service within the last 12 months, and with two or more consecutive years of service (excluding those positions for which the salaries are set by statute) as defined by Government Code Section 18992.

Or IV
Must be a person retired from the United States military, honorably discharged from active military duty with a service-connected disability, or honorably discharged from active duty as defined in Government Code Section 18991.

SPECIAL REQUIREMENTS
Membership in the State Bar of California (Applicants must have active membership in the State Bar before they will be eligible for appointments).

KNOWLEDGE AND ABILITIES
Applicants must demonstrate the ability to perform high administrative and policy – influencing functions effectively. Such overall ability requires possession of most of the following more specific knowledge and abilities:
(1) Knowledge of the organization and functions of California State Government including the organization and practices of the Legislature and the Executive Branch; principles, practices, and trends of public administration, organization, and management; techniques of organizing and motivating groups; program development and evaluation; methods of administrative problem solving; principles and practices of policy formulation and development; and personnel management techniques; the department’s or agency’s Equal Employment Opportunity Program objectives; and a manager’s role in the Equal Employment Opportunity Program.

(2) Ability to plan, organize, and direct the work of multidisciplinary professional and administrative staff; analyze administrative policies, organization, procedures and practices; integrate the activities of a diverse program to attain common goals; gain the confidence and support of top level administrators and advise them on a wide range of administrative matters; develop cooperative working relationships with representatives of all levels of government, the public, and the Legislature and Executive branches; analyze complex problems and recommend effective courses of action; and prepare and review reports; and effectively contribute to the department’s or agency’s Equal Employment Opportunity objectives.
These knowledge and abilities are expected to be obtained from the following kinds of experience with substantial participation in the formulation, operation and/or evaluation of program policies (experience may have been paid or volunteer; in State service, other government settings, or in a private organization):

CEA Level A Responsible for broad administrative and program activities, including the execution and/or evaluation of program policies.

CEA Level B Responsible for extensive managerial and program administration or broad program manager experience with substantial participation in the formulation, operation, and/or evaluation of program policies.

CEA Level C Responsible for extensive highly professional influence and contributes to program, policy, and the methods to provide professional services needed to set policies, to meet the mission of the State department and often exercising technical and or professional skills that are required at this level.

DESIRABLE QUALIFICATION(S)
Applicants are required to respond to the six supplemental items below for the Supplemental Application. These supplemental items are designed to identify job achievement in specific areas that demonstrate ability to successfully perform at the Assistant Chief Counsel, Department of Industrial Relations C.E.A. level.

Responses to the supplemental items will be assessed based on predetermined job-related rating criteria. In appraising the relative qualifications of candidates, consideration will be given to the extent and type of pertinent experience and education over and above that required under the minimum qualifications.

The Supplemental Application serves as documentation for each candidate's ability to present information clearly and concisely in writing and should be typed and no more than four pages in length.

Make sure your responses are complete, specific, clear, and concise.

Include place of employment, pertinent dates, duties performed, etc., when responding to items. In the event that one particular job contained responsibilities applicable to several items, separate the different functions of the job in order to respond to all items completely.

SUPPLEMENTAL ITEMS

1. Describe your knowledge and experience in labor and employment law including defense of employee claims of civil service, discrimination, pay violations, public works coverage determinations, apprenticeship standards, and mediation and conciliation.

2. Describe your experience in litigating difficult and sensitive issues in both state and federal court and before state and federal agencies.

3. Demonstrate your knowledge and experience in providing legal counsel and policy advice to executive level management.

4. Demonstrate your knowledge and experience with reviewing pending legislation and implementing policy initiatives.

5. Demonstrate your knowledge and understanding of the critical issues confronting the DIR.

6. Describe how you would accomplish reorganizing the structure and responsibilities of staff in an environment of changing issues.

EXAMINATION INFORMATION
A minimum rating of 70% must be attained to obtain list eligibility. Hiring interviews may be conducted with the most qualified candidates. All candidates will receive written notification of their examination results. The result of this examination will be used only to fill the position of Assistant Chief Counsel , with the INDUSTRIAL RELATIONS, DEPARTMENT OF. Applications will be retained for twelve months.

The results of this examination will be used only to fill this position.

The application and resume must include periods of employment (month/day/year) and civil service classification (not your working title). Interviews may be conducted with the most qualified candidates if it is determined necessary, in order to make a selection. Each candidate will be ranked competitively and notified of their examination results. Applicants who fail to submit all required documents listed above by the final file date will be eliminated from the examination.

On your Supplemental Application, you must list each Supplemental Item and describe your experience, knowledge and abilities as they relate to the Supplemental Items of the Desirable Qualifications section on this bulletin. You must provide specific examples.

Your performance in the examination described on this bulletin will be compared with the performance of others who take this test, and all candidates who pass will be ranked according to their scores.
