POSITION DESCRIPTION
Under the general direction of the Assistant Director, CalOHII, the Chief of the Health Information Policy and Standards (HIPS) Division, is responsible for functions of the HIPAA and Program Support Branch and Compliance Branch. The HIPAA and Program Support Branch, is responsible for statewide policy and leading and coordinating the implementation of the Health Insurance Portability and Accountability Act (HIPAA) by all impacted state entities. The Branch also provides support to program functions of HIPAA impacted state departments. The Compliance Branch is responsible for HIPAA compliance reviews of all state HIPAA covered entities and impacted departments and provides training and technical assistance. The incumbent provides oversight and policy direction to ensure collaborative policy and standards development for HIPAA-impacted state departments, Chief of the Health Information Policy and Standards (HIPS) Division provides policy input to the federal HIPAA privacy and security rule process, and ensures that the necessary communications, training, and liaison infrastructure are in place. Additionally, the HIPS Division is responsible for supporting standards development process for privacy and security of electronic health information in California.

Essential Functions

This position requires the ability and flexibility to perform and manage numerous complex and critical tasks concurrently, work in politically sensitive areas, under pressure in order to meet deadlines with overlapping timeframes. Even though CalOHII is located within the Health and Human Services Agency, it has statewide responsibility, as defined in Health and Safety Code Sections 130300 et seq, for all State departments impacted by HIPAA, including departments outside of this Agency and is responsible for ensuring HIPAA regulation compliance for all state entities covered by HIPAA.

The incumbent is required to have extensive knowledge of the federal policy-making process including the process for adopting regulations; the State legislative process; essential principles of planning and compliance; exercise a high degree of initiative, independence of action and originality; demonstrate tact and independent judgment; communicate effectively, be able to lead multi-disciplinary/multi-departmental/State-county work groups; maintain effective working relationships with health care industry stakeholders, local government, control agencies, and other state departments. The incumbent must be able to manage and easily adapt to changing priorities; plan and project workload to meet demands; and maintain consistent, predictable attendance in the performance of these functions.

Specific Duties

30% Acts as the principal program manager for HIPAA policy, standards development, implementation, and compliance reviews for all HIPAA covered entities and impacted State departments; Provides technical assistance to state departments with the implementation of the policy and standards; Ensures timely, complete, and accurate interpretation and dissemination of final federal laws and regulations to State departments; as well as developing and disseminating State policy necessary to maintain and ensure uniform and consistent application of federal standards.

20% Provides direction and leadership to ensure the development and implementation of training programs and the development of tools designed to inform and assist State departments about federal and State initiatives in the area of health information policy.

15% Develops the Strategic plan, timeframes, and approach to HIPAA standards setting process for California. Manages both state and stakeholder resources based on those plans.

15% Represents the State of California on state and national HIPAA and Health Information Exchange task forces, work groups, and organizations.

10% Oversees CalOHII’s legislative functions including analysis of federal and State legislation. Develops proposed language for State legislation necessary for the implementation of health information standards and serves as the point of contact for State departments or members of the Legislature. Coordinated statewide input on federal Notices of Proposed Rulemakings (NPRM) providing a single voice for California on NPRMs.

10% Plans, organizes, and manages the budget and work of contractors who provide subject matter expertise to assist with technical assistance for state departments, the development and update of policies for the State Health Information Policy Manual and tools issued by CalOHII; reviews and approves contractor plans and deliverables.

MINIMUM QUALIFICATIONS
Applicants must meet the following minimum qualifications:

Either I
Must be a current State civil service employee with permanent civil service status, as defined in Government Code Section 18546.

Or II
Must be a current or former employee of the Legislature, who resigned or was released from service within the last 12 months, and with two or more consecutive years of service as defined in Government Code Section 18990.

Or III
Must be a current or former nonelected exempt employee of the Executive Branch of government who resigned or was released from service within the last 12 months, and with two or more consecutive years of service (excluding those positions for which the salaries are set by statute) as defined by Government Code Section 18992.

Or IV
Must be a person retired from the United States military, honorably discharged from active military duty with a service-connected disability, or honorably discharged from active duty as defined in Government Code Section 18991.

KNOWLEDGE AND ABILITIES
Applicants must demonstrate the ability to perform high administrative and policy – influencing functions effectively. Such overall ability requires possession of most of the following more specific knowledge and abilities:
(1) Knowledge of the organization and functions of California State Government including the organization and practices of the Legislature and the Executive Branch; principles, practices, and trends of public administration, organization, and management; techniques of organizing and motivating groups; program development and evaluation; methods of administrative problem solving; principles and practices of policy formulation and development; and personnel management techniques; the department’s or agency’s Equal Employment Opportunity Program objectives; and a manager’s role in the Equal Employment Opportunity Program.

(2) Ability to plan, organize, and direct the work of multidisciplinary professional and administrative staff; analyze administrative policies, organization, procedures and practices; integrate the activities of a diverse program to attain common goals; gain the confidence and support of top level administrators and advise them on a wide range of administrative matters; develop cooperative working relationships with representatives of all levels of government, the public, and the Legislature and Executive branches; analyze complex problems and recommend effective courses of action; and prepare and review reports; and effectively contribute to the department’s or agency’s Equal Employment Opportunity objectives.
These knowledge and abilities are expected to be obtained from the following kinds of experience with substantial participation in the formulation, operation and/or evaluation of program policies (experience may have been paid or volunteer; in State service, other government settings, or in a private organization):

CEA Level A Responsible for broad administrative and program activities, including the execution and/or evaluation of program policies.

CEA Level B Responsible for extensive managerial and program administration or broad program manager experience with substantial participation in the formulation, operation, and/or evaluation of program policies.

CEA Level C Responsible for extensive highly professional influence and contributes to program, policy, and the methods to provide professional services needed to set policies, to meet the mission of the State department and often exercising technical and or professional skills that are required at this level.

DESIRABLE QUALIFICATION(S)
a) Demonstrated ability to establish and maintain effective relationships, and professionally represent and negotiate state health information policies and perspectives to members of the California Legislature, their staff, legislative policy and budget committee staff, Governor’s Office, Department of Finance, Joint Legislative Budget Committee, and other individuals involved in the legislative process.

b) Demonstrated knowledge of the California Health and Human Services Agency and its departments, as well as other state agencies such as the Department of Managed Care, Department of Insurance, including broad-based background of their roles in developing electronic health standards.

c) Ability to successfully manage the work of others, whether through direct or functional supervision, or as project lead of multi-disciplinary, multi-department, state-county workgroups associated with health information activities.

d) Ability to effectively represent California on national privacy and security task forces to ensure timely, complete, and accurate interpretation and dissemination of final federal laws and regulations.

e) Ability to effectively manage technically expert contractors and ensure deliverables are completed on time and on budget.

f) Knowledge of the federal policy-making and legislative process, including the process for regulation adoption.

g) Ability to demonstrate tact and independent judgment, and to work in politically sensitive areas, under significant pressure and short timeframes.

h) Ability to develop and maintain effective working relationships with health care industry stakeholders and local governments.

EXAMINATION INFORMATION
A minimum rating of 70% must be attained to obtain list eligibility. Hiring interviews may be conducted with the most qualified candidates. All candidates will receive written notification of their examination results. The result of this examination will be used only to fill the position of CHIEF, HEALTH INFORMATION POLICY DIVISION , with the CALIFORNIA HEALTH AND HUMAN SERVICES AGENCY. Applications will be retained for twelve months.

The results of this examination will be used only to fill this position.

The examination will consist of a designated screening committee established to screen applications and a two-page statement of qualifications. The statement of qualifications will be submitted on two 8 ½” x 11” pages, with 1” margins, and a font size no smaller than Arial 11. The minimum qualifications and desirable qualifications listed above will be used to screen the application and two-page statement of qualifications. Therefore, it is critical that each applicant includes specific information on how his/her background, knowledge and abilities specifically meet the minimum qualifications and desirable qualifications.
